Introduction

Welcome to Kalamni. By using our app, you agree to comply with and be bound by the following terms and conditions. Please read them carefully before using the application.

Age Requirement

You must be at least 16 years of age to use Kalamni. By using this application, you represent and warrant that you are 16 or older and that you agree to and will abide by all of the terms and conditions of this Agreement. If we discover that a user is under 16 years of age, we will immediately terminate their account.

Use of the Application

By accessing or using Kalamni, you agree to:

  • Use the app only for lawful purposes and in compliance with all applicable laws and regulations.
  • Respect other users by refraining from sharing offensive, inappropriate, or prohibited content.
  • Ensure that any topics you add to the app comply with our Prohibited Content Policy.
  • Provide accurate information about your age, and confirm you are at least 16 years old.
  • Not attempt to access another user's account or impersonate any person or entity.
  • Not use automated systems (bots) to access or interact with the service.

Location Services

Kalamni offers an optional premium feature called 'Seek Nearby' that uses your device's GPS location to match you with users within a specified radius. By enabling this feature, you acknowledge and agree that:

  • You grant Kalamni permission to access your device's precise location data
  • Location data is used only during active matching sessions and is not stored permanently
  • Other users will not see your exact location, only that you are within their search radius
  • You can disable location services at any time through your device settings or app preferences
  • You are responsible for ensuring your safety when meeting users matched through location-based features

Safety Warning: Kalamni is a chat application. We do not encourage or facilitate in-person meetings. If you choose to meet someone you connected with through the app, you do so entirely at your own risk. Always meet in public places, inform someone you trust, and follow standard safety precautions.

User Conduct and Responsibility

You are solely responsible for your conduct and any data, text, information, screen names, graphics, photos, profiles, audio and video clips, links, or other content that you submit, post, and display on the Kalamni service.

Because all chats are end-to-end encrypted, we do not and cannot monitor or moderate conversations. You acknowledge and agree that Kalamni is not responsible or liable for the conduct of any user. You interact with other users at your own risk.

You agree to be respectful and responsible in your interactions. You must not:

  • Harass, threaten, impersonate, or intimidate other users.
  • Transmit any content that is unlawful, libelous, defamatory, obscene, pornographic, indecent, lewd, suggestive, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory, fraudulent or otherwise objectionable.
  • Use the service for any illegal or unauthorized purpose.

While we cannot see your chat content, if a user is reported for violating these terms and sufficient evidence is provided by the reporter, we reserve the right to terminate the reported user's access to the service.

Prohibited Content

To maintain a safe and compliant environment, users are strictly prohibited from posting, sharing, or discussing topics that include:

  • Profanity or obscene language.
  • Hate speech or discriminatory remarks.
  • Illegal activities or explicit content.
  • Spam, scams, or fraudulent schemes.

Violation of this policy may result in immediate termination of access to the app.

Disclaimer of Warranties

The application is provided "as is" and "as available." Kalamni makes no warranties, expressed or implied, and disclaims all other warranties, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

Limitation of Liability

In no event shall Kalamni, its developers, or affiliates be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not to, damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the service; (ii) any conduct or content of any third party on the service, including without limitation, any defamatory, offensive, or illegal conduct of other users or third parties; (iii) any content obtained from the service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

Indemnification

You agree to defend, indemnify, and hold harmless Kalamni and its developers from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms and Conditions; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your content caused damage to a third party. This defense and indemnification obligation will survive these Terms and Conditions and your use of the Service.

Account Termination and Deletion

Termination by Kalamni

We reserve the right to suspend or terminate your access to Kalamni at any time without prior notice if you:

  • Violate these Terms and Conditions
  • Engage in prohibited activities or share prohibited content
  • Harass, threaten, or harm other users
  • Attempt to circumvent security measures or exploit the service
  • Provide false information or misrepresent your identity

Important: Blocked users cannot create new accounts or request account deletion. Attempting to circumvent a block by creating new accounts will result in permanent ban from the service.

Voluntary Account Deletion

You may request deletion of your account at any time through the app's Profile settings. By requesting account deletion, you acknowledge and agree that:

  • Your account will be marked for deletion and permanently removed after 30 days
  • You can cancel the deletion request by logging back in within the 30-day grace period
  • You will lose access to any premium features or purchases (non-refundable)
  • Your device ID and purchase history will be permanently deleted from our servers
  • You will need to create a new account to use the service again
  • Blocked users are not eligible to request account deletion

Purchases and Refunds

Kalamni offers premium features through in-app purchases. By making a purchase, you agree that:

  • All purchases are final and non-refundable except as required by applicable law
  • Premium access is tied to your device ID and cannot be transferred to another account
  • If you delete your account, you forfeit any remaining premium access
  • If your account is terminated for violating these terms, you forfeit all purchases
  • Refund requests must be made through the Apple App Store or Google Play Store

Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which Kalamni operates, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms and Conditions or the use of Kalamni shall be resolved through binding arbitration, except where prohibited by law. You agree to waive your right to participate in a class action lawsuit or class-wide arbitration.

Severability

If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms and Conditions will otherwise remain in full force and effect.

Entire Agreement

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and Kalamni regarding the use of the service and supersede all prior agreements and understandings.

Changes to Terms and Conditions

We may update these Terms and Conditions from time to time. We will notify you of any material changes by posting the new Terms and Conditions on this page and updating the 'Effective Date' at the top. Continued use of Kalamni after changes to these terms constitutes acceptance of those changes.
